    Consecutive sentences are appropriate because they are separate and distinct acts.

    Slaughter: Asking that Jackson be sentenced to three life terms without possibility of parole. 

    She is asking that they run consecutively. 

    Each murder is separate and distinct. Heinous, brutal nature of the homicides warrant the three life sentences. He was callous and he wanted them to die. 

    Jackson then tried to cover up what he did. He shot himself in foot to blame it on a phantom burglar. 

    These murders shook the community - an execution of three family members.

    Judge Anderson: Issues with jurors were dealt with during jury selection. Some said they hadn't seen anything on the case or saw one news story. 

    He is standing by his initial ruling denying moving trial out of county. 

    Jackson didn't renew his motion for change of venue. 

    Stands by his denial of judgment of acquittal during trial.   

    The hearsay issue was dealt with during trial and he stands by his ruling. 

    Denies motion for new trial.

    First Assistant Linn County Attorney Monica Slaughter resists the defense motion for new trial.

    During jury selection, they struck all the jurors that had information about the case. She doesn't agree that there was jury misconduct during the trial. 

    As for confronting witnesses, nothing was offered by these people Johnston mentioned in his motion. There is no confrontation issue.

    Tyler Johnston is arguing this was a case that should have been moved out of the county

    He also is arguing that prosecution put in hearsay statements about nobody seeing any intruders. 

    Court shouldn't have submitted those, he said.

    Jackson filed a motion for a new trial based on several errors they alleged occured during trial.

    Chief Judge Lars Anderson will first take up the motion and then proceed to sentencing, unless the judge grants a new trial. This is a typical motion when someone is convicted.
