Keen: People who are paroled from prison aren't allowed to hang out in bars, drink alcohol, be with other felons and commit crimes.
Keen is excused.
Keen: He would file report violations which set out what they did to violate rules. In one report, he wrote Valentine was a concern to the community.
He revoked him on 5th time he asked the court to revoke. He was sent to prison in Oct. 2016.
Keen on cross: He hasn't had any contact with him since 2015-2016. He didn't know Valentine in spring of 2022 and knew nothing of his recent reputation.
Keen: Probationers have to follow rules while on probation. Valentine could follow the rules but didn't. He recommended that Valentine should be revoked because Valentine continued to violate probation.

He supervised Valentine in 2015 and 2016. Keen was a intensive probation officer. He had more contact with probationers at risk to reoffend.

Schulte: When someone is listed as a suspect does it mean there is evidence of guilt?
Eganhouse: They are just associated with the case.
Meyerdirk on re-direct: Who is suspect listed on report?
Eganhouse: Valentine. Victims are Walker and another person.
Eganhouse on cross: There were three DNA profiles from gun. None matched Valentine. No physical evidence linking Valentine to gun or cartridges.
Eganhouse: He sent three casings to the lab. They recovered 12. They send best examples they might have.

Eganhouse: The gun, serial number FWC146, found in garbage can Jan. 9, 2016 was tested for fingerprints, along with shell casings at crime lab.
According to firearms report, Eganhouse said the cartridges came from the Glock 22 gun.
Meyerdirk: Were there any other suspects for the firearm?
Hepke: I'm not sure how to anwer that. I didn't see him with firearm. Crime scene unit processes to see if they can generate a fingerprint. No other suspects but Valentine generated.
Hepke is excused.
Hepke: In other investigations, he has found guns in garbage cans. The laundry room wasn't in a secured building. He didn't arrest Valentine for possessing a gun.
On cross: Hepke said the apartment complex where he found gun had more than 3 or 4 buildings. He was in 2050 building. Doesn't know how many apartments in that building. Maybe more than 10. Multiple floors.
Besides seeing Valentine, he also saw two other Black individuals.
Hepke: Valentine didn't have a gun on him and didn't see him with a gun.
Meyerdirk is asking Hepke if he would recognize the serial number on the gun he found.
Hepke: Some of the serial number was missing. FWC146 from slide of gun.
Hepke: He took photos of gun and took it back to station. He doesn't know where Valentine went after he found gun.
Hepke: When he was following Valentine, Valentine started walking faster. They ended up in a laundry area. He looked in garbage can and found a semi-automatice gun with an extended magazine. He doesn't know if it had ammo in it.
He didn't see Valentine by the garbage can or see him put it in can.

Hepke: He responded to narcotics call on Glass Road in January 2016. - smell of drugs at an apartment. He came across Michael Valentine.
Meyerdirk: How many times have you encountered Valentine?
Hepke: He doesn't know.
Hepke: When he saw him that day, he started following you because he knew he was involved with firearms. He knew it was possible that he was armed.

Bergen: He was on duty Jan. 9, 2016. He got a call for shots fired to 1800 blk of 1st Ave., around Wells Fargo Bank parking lot. There was shattered glass in roadway. They blocked off area. They found shell casings.
The defense is trying to prove that Walker had previous shooting incidents with Valentine. One of them being in 2016.
Meyerdirk on re-direct: Did officer Christy tell you who the shooter was?
Boesenberg: I don't recall.
Meyerdirk: When Walker told you he didn't know who shot him, you didn't believe him?
Boesenberg: He doesn't know. He asked Walker for a description. He did believe Walker knew who shot him.
Boesenberg: Walker said suspect may have been 6 foot 2 or 6 foot 3.
Schulte: Michael Valentine is much shorter?
Boesenberg; He doesn't know.
Schulte: Walker couldn't tell police who shot him?
Boesenberg: No.
Schulte on cross: This incident happened over 6 years ago?
Boesenberg: Yes.
Schulte: You were involved in other shooting investigations over the years?
Boesenberg: Possibly over 50 years - he estimates.
Boesenberg: He asked Walker to give them a description of person who shot him.
Meyerdirk: Was Walker confronted by police asking him to give up the name of the suspect?
Boesenberg: He doesn't remember that.
Boesenberg: He doesn't remember if there was suspect.
He doesn't know if other officers were in the room with him that night.
Meyerdirk asks if officer Christopher Christy was there that night.
Boesenberg: He would have to review his report.
Meyerdirk asked if there's a shooting, doesn't a hospital go into a lock down?
Boesenberg: He doesn't know the procedure.
Meyerdirk asked if he came into contact with Walker in 2016.
Boesenberg said it was regarding a shooting incident in 2016. Walker was in the ER at the hospital. He was suffering from a gunshot wound.
